Mayer Brown Issues Formal Complaint Exposing Prosecutorial Misconduct in the Department of Justice
WASHINGTON, D.C. — A formal complaint and request for investigation was filed yesterday evening with the Inspector General and the Office of Professional Responsibility within the Department of Justice regarding misconduct committed by Gary Restaino, an Assistant United States Attorney in Arizona, and Daniel Odom, a Special Agent of the Federal Bureau of Investigation.
Kelly Kramer, Mayer Brown partner and co-leader of the firm’s White Collar Defense and Compliance practice, has filed a report laying out proven facts, court citations, and court-imposed sanctions against the corrupt acts of AUSA Restaino and SA Odom in the political witchhunt against former Congressman Renzi. The letter exposes how these corrupt officials used a fabricated foreign dossier, illegally wiretapped Congressman Renzi’s attorneys, destroyed evidence, lied to the court, dangled financial payoffs in exchange for changed testimony, withheld exculpatory evidence, and knowingly sponsored false testimony to a jury—all to destroy an innocent man they politically opposed.
Excerpts from the Letter
“I am compelled to write here because, in my view, the misconduct in Mr. Renzi’s case was repeated, concealed, and corrosive. In an effort to secure its conviction, the government cheated—not once, but repeatedly—before, during, and after the trial. The government not only deprived Mr. Renzi of his constitutional right to a fair trial, but it allowed the jury to convict an innocent man.
”We submit that the prosecution and investigation of Mr. Renzi’s case violated his basic constitutional right to a fair trial. Mr. Renzi respectfully requests that you conduct a full, fair, and thorough review.”
